TERMS AND CONDITIONS OF SALE B to C – MOTORSPORT MUSEUM
PREAMBLE
MACO, société par actions simplifiée [simplified joint stock company] under French law, with its registered office at Place Luigi Chinetti, Circuit des 24 Heures – 72019 Le Mans, registered with the RCS of LE MANS under number 917 458 812, organises and markets notably guided (individual or group) or self-guided tours within the Motorsport Museum at 9 place Luigi Chinetti, 72100 Le Mans (hereinafter referred to as the “M24”).
1. PURPOSE
1.1 These terms and conditions of sale (hereinafter referred to as the “TCS”) are entered into between MACO and any natural person wishing to book a guided or self-guided tour and/or a workshop within the M24 (hereinafter referred to as the “Customer”).
Every request to book a guided or self-guided tour and/or a workshop within the M24 by the Customer, where the availability is confirmed by MACO, (hereinafter referred to as an “Order”) is governed by the TCS in force on the date of the booking request. A guided tour is a tour undertaken by the Customer accompanied by a guide. A self-guided tour is a tour undertaken by the Customer without the presence of a guide. A workshop is the activities carried out by the Customer in the presence of a cultural ambassador.
1.2 The Customer acknowledges having the capacity to contract under the conditions described in the TCS presented hereunder, i.e. that he is over the age of 18 and not under guardianship or judicial protection.
1.3 Minors under the age of 16 can visit the M24 and/or participate in a workshop if accompanied by a legal representative. In any event, the Order must be placed by an adult holding parental authority or duly empowered for that purpose.
2. BOOKING REQUEST / ACCEPTANCE OF the TERMS AND CONDITIONS of SALE / ABSENCE OF COOLING-OFF PERIOD
2.1 Orders can be made remotely, either online at the M24 website or by email to the address heritage@lemans.org, or directly at an M24 ticket office.
2.2 When making an Order on the M24 website for the first time, the Customer must create a “Customer Account” and enter all information requested (title, surname, forename, password, password confirmation, date of birth, mobile number, email address, postcode). If the Customer already has a “Customer Account”, he must log in by entering his email address and password. The Customer must then select the date and time of his chosen tour from among the available dates and times at the time of making his Order.
2.3 To be able to submit the Order, the Customer must read and accept the TCS by ticking the box provided for that purpose. Consequently, any submission of Order entails the Customer’s full adhesion to the MACO BtoC TCS.
2.4 Once the Order is submitted by the Customer, he will receive a confirmation email acknowledging receipt of the Order to the email address entered when the account was created. This acknowledgement of receipt will state that the Order has been received, confirmed by MACO, and paid (subject to validity of the payment transaction). The Customer can find his Order in the confirmation email by clicking on “download my ticket”, which will generate the ticket in PDF format.
2.5 This ticket is an electronic ticket which can be presented in digital format on a phone screen, or printed in its entirety on one side of a clean white A4 sheet of paper, in colour or black & white, in portrait mode without modification of the print size, with an inkjet or laser printer.
2.6 Pursuant to the provisions of the French Consumer Code, MACO reserves the right to refuse any Order for legitimate reasons, notably in case of abnormal or fraudulent orders, or it may request supporting documents.
2.7 The Order submitted by the Customer constitutes a final offer. The contract of sale is deemed complete from receipt by the Customer of the confirmation email acknowledging receipt of the Order at the email address entered when the account was created.
2.8 In case of purchase directly at an M24 ticket office, the TCS can be viewed on request to the M24 cashier, and they are displayed on the information board at the M24 entrance. The Order is deemed accepted by MACO after payment of its amount in full by the Customer, in compliance with the provisions of Article 3.3 below.
2.9 In case of purchase via exchange of emails at the address heritage@lemans.org, the TCS will be either attached to the quotation sent to the Customer by MACO or sent as a separate attachment.
3. PRICE AND PAYMENT
3.1 The applicable rate is the rate in force at the time of payment of the Order by the Customer.
3.2 Specific reduced rates are applicable for some people (Disabled, Young People, Students, etc.). These reduced rates are applicable provided that the Customer is able to present the corresponding evidence upon arrival at the M24.
Without presentation of the corresponding evidence, a supplement representing the difference between the full rate and the reduced rate will be due and must be paid. Otherwise the tour and/or workshop cannot take place and will not be refunded.
3.3 Payment must be made upon submission of the Order, by bank card for an internet payment and/or in cash upon booking directly at an M24 ticket office. Only Visa, Eurocard, MasterCard and American Express are accepted by MACO.
4. REFUND / EXCHANGE
4.1 No lost or stolen ticket will be refunded by MACO, even on presentation of supporting documents.
4.2 No exchange or reimbursement will be given by MACO if the Customer is unable to attend on the agreed booking date and time, even on presentation of supporting documents (with the exception of an event of force majeure as defined in Article 5 below).
4.3 Some exhibition rooms may be partially or completely closed during periods of setup or dismantling or for service requirements. No refund or compensation shall be given to the Customer on that ground.
5. POSTPONEMENT / CANCELLATION / FORCE MAJEURE
5.1 MACO reserves the right to postpone or cancel the tour and/or workshop owing to duly justified technical, safety or organisational problems. These may include an exceptional closure of the museum (works, technical incident, security alert, strike) or the cancellation of a guided tour owing to unavailability of the guide.
In the event where MACO and the Customer cannot postpone the tour and/or workshop within a period of one year from the date initially booked, MACO will cancel the tour and/or workshop and refund the Customer in full, to the exclusion of any other compensation whatsoever.
5.2 In case of event of force majeure, as defined by Article 1218 of the French Civil Code, preventing the Customer or MACO from fulfilling their obligations, the booking will be automatically cancelled, without compensation on either side, apart from a refund of the ticket to the Customer.
For the Customer, the following may notably be considered as events of force majeure, subject to production of supporting documents:
- serious illness, accident or hospitalisation preventing the trip;
- death of the ticket holder or a member of their family;
- natural disaster making it impossible to travel to the museum;
- a technical malfunction attributable to the ticketing system having prevented issuance of the ticket or entailed double billing.
5.3 The Customer is informed that pursuant to Article L. 221-28 (12) of the French Consumer Code, the sale of a dated ticket is not subject to application of the cooling-off period.
6. OPENING HOURS / TERMS AND CONDITIONS OF THE TOUR
6.1 The M24 is open every day of the year except 25 December and 1st January, from 1st October to 30 April from 10am until 6pm, and from 1st May to 30 September from 10am until 7pm. Last entries are 1 hour before closure.

6.2 The Customer undertakes to scrupulously respect the times stipulated for his tour and/or workshop, estimated at a duration of around 1 hour 45 minutes. Any booking not attended and not cancelled 72 business hours before the date of the tour shall remain due and will not be refunded. If the Customer is late by 20 minutes or more, MACO reserves the right to cancel the tour and/or workshop without refund. If you are running late, please notify M24 as soon as possible:

6.3 MACO reserves the right to refuse access to M24 to any person behaving in a manner incompatible with the tour and/or workshop.
Participation in the tour and/or workshop entails irrevocable adhesion of the Customer to the TCS, the Rules of Procedure of the Le Mans Circuits, which can be viewed at https://www.M24-musee.com/ and are displayed within the M24, and the tour instructions displayed within the M24.
6.4 MACO cannot be held liable in case of failure by the Customer to comply with the TCS, the Rules of Procedure of the Le Mans Circuits, and/or the tour instructions. The Customer waives any right and remedy against MACO and/or the ACO.
6.5 Only assistance dogs for the disabled are admitted within the M24.
7. DATA PROTECTION
7.1 The Customer is informed that personal data are necessary to accept, manage and monitor his Order and his participation in tours and/or workshops. They may be communicated to service providers or subcontractors of MACO for the performance of the services they provide, notably to the publisher of the online ticketing solution. They may also be used by MACO to send information and marketing information, when the Customer has expressly consented thereto. They are kept for the duration necessary to manage and monitor the order and the participation in the tours, and in compliance with the applicable legal time limitation periods.
7.2 In compliance with the applicable legislation, the Customer is informed that he holds a right of access, rectification and erasure of his data, a right to restriction of processing of his data, and a right to portability of his data.

8. DISPUTES, APPLICABLE LAW, jurisdiction
8.1 The TCS are subject to French law in every respect. MACO and the Customer shall endeavour to amicably resolve any dispute arising out of the interpretation or performance of these TCS.
8.2 Any consumer dispute must be sent first in writing to MACO Customer Services (juridique@lemans.org) before any request for mediation.
8.3 If the dispute between the consumer Customer and MACO cannot be resolved amicably, including by mediation, it shall be submitted to the jurisdiction of the competent courts pursuant to the French Code of Civil Procedure or, if seised by the consumer Customer, to the jurisdiction of the Court of his place of residence at the time of the Order or occurrence of the proximate cause.
